Second Hand Products Sales Policy

Buyer protection, inspection rules, delivery, and seller obligations across Nigeria.

Important Notice (Draft for Legal Review): This policy outlines marketplace rules for pre-owned ("Second Hand") transactions on Kanemtrade and does not constitute formal legal advice. It is subject to review and enforcement pursuant to the laws of the Federal Republic of Nigeria.

Effective Date: October 2026

Kanemtrade provides a trusted, escrow-protected marketplace connecting buyers and sellers of pre-owned, refurbished, and gently used items across Nigeria. By listing or purchasing a second hand product on Kanemtrade, you agree to comply with the terms set forth below.

1. Eligible Items & Strictly Prohibited Goods

Second hand listings must represent authentic, legally owned, pre-owned personal or commercial goods in working order (or with defects explicitly disclosed).

Strictly Prohibited Items:

Stolen goods, looted merchandise, or property without proof of legitimate ownership.
Counterfeit goods, replicas, fake luxury items, or unauthorized copyright reproductions.
Firearms, ammunition, explosives, weapons, or tactical military gear.
Narcotics, prescription drugs, unverified pharmaceuticals, or banned chemicals.
Stolen electronics with active iCloud, Google FRP, or IMEI blacklist locks.
Pornographic, obscene, or adult-themed materials.
Any product restricted or banned by Nigerian customs or government regulatory bodies (e.g. NAFDAC, SON, FCCPC).

Violators are subject to immediate account termination, forfeiture of escrow funds, and reporting to law enforcement authorities (including the Nigeria Police Force and EFCC).

2. Seller Accuracy, Condition Disclosure & Responsibilities

Accurate Photography: Sellers must provide actual, unaltered photos of the specific item offered for sale. Stock images or photos copied from other websites are strictly prohibited.
Mandatory Flaw Disclosure: Any dents, scratches, operational flaws, battery health degradation, missing accessories, or past repairs must be clearly documented in the description.
Condition Grading: Listings must be honestly categorized (e.g., "Like New", "Gently Used", "Fair", or "For Parts/Repair"). Intentional misrepresentation constitutes fraud.
Dispatch Window: Upon receiving payment notification, sellers must hand over the item to Kanemtrade logistics, designated carrier, or agreed pickup point within 48 hours.

3. Kanemtrade Escrow & Buyer Protection

To protect buyers against fraud and substandard goods, Kanemtrade operates an integrated Escrow Protection System for all automated second hand purchases.

1. Funds Held Securely

Payment is held in escrow by Kanemtrade. The seller is NOT paid until the buyer receives and inspects the item.

2. 48-Hour Inspection Window

Buyers have 48 hours from verified delivery/pickup to inspect the item against the listing description.

3. Payout or Refund

Once confirmed (or after 48h without dispute), funds are disbursed to the seller's Kanemtrade wallet.

4. Delivery, Pickup & Unpaid Order Expiry

30-Minute Temporary Reservation: When a buyer initiates an order, the unique item is atomically locked for 30 minutes to allow payment completion. If payment is not completed within 30 minutes, the hold expires automatically and the item is restored to the marketplace.
Logistics & Pickup Points: Buyers can choose Home Delivery via Kanemtrade partner carriers or self-pickup at authorized Kanemtrade pickup stations. Tracking updates are sent via SMS, push notification, and email.
Inspection at Pickup: For pickup point deliveries, buyers are advised to inspect the package in the presence of the station agent prior to signing acceptance.

5. Returns, Refunds & Dispute Resolution

Dispute Grounds: Returns are approved if the item received is significantly different from described, defective (without disclosure), counterfeit, or missing essential components.
Change of Mind Exemption: Because second hand items are unique and individual, returns based solely on buyer remorse or "change of mind" are generally not supported unless agreed in writing by the seller.
Dispute Filing: Disputes must be raised through Kanemtrade Support or the Order Details page within 48 hours of delivery with photo and video evidence.

6. Contact Privacy & Off-Platform Transactions

Warning on Direct Off-Platform Transfers: When using the "Call" or "Chat" feature to contact sellers directly, Kanemtrade logs call actions anonymously for anti-harassment and security purposes. If you choose to send money directly to a seller outside Kanemtrade's automated checkout and escrow protection, Kanemtrade CANNOT guarantee recovery or accept liability for fraud.

7. Governing Law & Dispute Jurisdiction

This policy is governed by and construed in accordance with the laws of the Federal Republic of Nigeria, including consumer protection directives issued by the Federal Competition and Consumer Protection Commission (FCCPC). Any legal proceedings arising from transactions on this platform shall be subject to the competent courts of Nigeria.
